General Terms and Conditions (GTC) of Youvendo GmbH

§1 Applicability to consumers and definitions

(1) The following General Terms and Conditions apply to all contracts concluded via our online shop at www.mizodia.com between us,

and the customer, in the version valid at the time the contract is concluded. Deviating general terms and conditions of the customer are not recognized unless we expressly agree to their validity in writing.

The product range in our online shop is aimed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity (§ 13 BGB, German Civil Code).

§2 Conclusion of a contract, storage of the contract text

(1) The presentation and advertising of goods in our online shop does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the customer to order goods.

(2) By clicking the "Buy" button in the last step of the order process or by clicking the "Pay now" button when using the "PayPal" payment method, the customer submits a binding offer to conclude a contract for the purchase or booking of the goods and/or services shown in the order summary (offer).

(3) The order is placed in the following steps:

  1. Selection of the desired goods and color
  2. Adding the goods to the shopping cart by clicking the "Add to cart" button
  3. Selecting further items or viewing the shopping cart
  4. Checking the details in the shopping cart and making changes if necessary
  5. Clicking the "Checkout" button
  6. Logging in to the online shop or Express Checkout of the payment service "PayPal" (prior registration required in each case) and entering the login details (e-mail address and password) or entering the contact and delivery address and, if applicable, entering a voucher or discount code
  7. Clicking the "Continue to shipping" button
  8. Checking or correcting the respective entered data again
  9. Selecting the shipping method
  10. Clicking the "Continue to payment" button
  11. Selecting the means of payment and entering the required information
  12. Binding submission of the order by clicking the "Buy" button or, if the payment service "PayPal" is selected, by clicking the "Pay now" button

After checking their details and before bindingly submitting the order, the customer can return to the website on which the customer's details are recorded by pressing the "Back" button in the internet browser they are using or by clicking the "Change" button next to the contact details and shipping information, and correct input errors, or cancel the order process by closing the internet browser.

(4) We confirm receipt of the order immediately by an automatically generated e-mail ("confirmation of receipt"). A valid contract is only concluded with the shipping confirmation by e-mail (acceptance).

(5) We will send the customer the contract text (details of the order) and our GTC including the withdrawal notice by e-mail. The customer can also view the GTC at any time at https://mizodia.com/policies/terms-of-service. For security reasons, the order data is no longer accessible via the website. If the customer has a customer account, the orders are displayed there.

(6) The customer can place orders in our online shop as a guest or as a registered user. As a registered user, the customer does not have to enter their personal data each time, but can simply log in to the customer account before or during an order using the e-mail address and the password freely chosen during registration. Registration alone does not entail any obligation to purchase the goods we offer. The access data for the account must be treated confidentially and must not be passed on to third parties. (7) The contract is concluded in German.

§3 Prices, shipping costs, payment

(1) The prices stated include statutory VAT and other price components. Any shipping costs are added, unless otherwise specified below. The shipping costs are stated in our price information in our online shop. The price including VAT and applicable shipping costs is also displayed in the order form before the customer submits the order.

(2) The customer has the option of paying by PayPal, credit card (Visa, American Express, Master Card), Klarna and, depending on the buyer's location, also Apple Pay, Bancontact, eps transfer, Google Pay, Ideal, Shop Pay and UnionPay. The respective terms of use of the payment service apply. Further information on Klarna can be found at the end of the GTC ("Information on Klarna").

§4 Delivery

(1) Unless we have stated otherwise in the product description, delivery takes place within approx. 3 to 7 working days (Monday to Friday). The delivery period begins on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday or public holiday at the place of delivery, the period ends on the next working day.

(2) Express shipping: Parcels posted on a working day by 2 p.m. are usually delivered within Germany within 24 hours. Orders placed on a Friday before 2 p.m. are delivered on the following Monday.

(3) The risk of accidental loss and accidental deterioration of the sold item passes to the customer, even in the case of a sale involving shipment, only upon handover of the item to the customer or upon the customer's default of acceptance, provided the customer is a consumer.

(4) If there are delivery difficulties at the time of ordering or if a product is no longer stocked at the time of ordering, we will inform the customer immediately and refrain from acceptance. We will immediately refund the customer any amounts already paid to us for the unavailable products.

(5) If we are unable to deliver a shipment, we will keep the delivery in our warehouse for up to 10 days. In this case, a notification will be left for the customer, from which the customer can see where their order is located and how they can receive it. If the customer does not contact us within a period set by us to arrange delivery, we are entitled to withdraw from the contract. We will refund the purchase price paid as quickly as possible, at the latest within 14 days from the time of the declaration of withdrawal. In such cases, we are entitled to invoice the customer for all shipping costs and other costs resulting from the termination of the contract as damage.

§5 Retention of title and prohibition of resale

(1) We retain title to the goods until the purchase price has been paid in full.

(2) The customer warrants that the products will be used exclusively for private purposes. Any commercial resale of the purchased products is prohibited.

§6 Right of withdrawal

(1) If the customer is a consumer, they have a statutory right of withdrawal in accordance with the following withdrawal notice.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us (Youvendo GmbH, Im Stöckacker 18, 79224 Umkirch, +49 (0)7665 9348062, support@mizodia.com) of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse you all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functioning.

The right of withdrawal does not exist for contracts for the delivery of goods that are not prefabricated and for whose manufacture an individual selection or determination by the buyer is decisive or which are clearly tailored to the personal needs of the buyer, as well as for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

(2) Orders of Mizodia jewelry sets can only be withdrawn from in their entirety and must be returned in their entirety. A full refund will only be made if the order has been returned in full. Rights in respect of defects relating to individual items remain unaffected. Therefore, if a product is missing or if individual items are defective, this must be reported to customer service.

§7 Warranty

The statutory warranty provisions apply unless otherwise specified below.

§8 Limitation of liability

(1) In all cases of contractual and non-contractual liability, we are liable to the customer for damages or reimbursement of futile expenses in cases of intent and gross negligence in accordance with the statutory provisions.

(2) In other cases, we are only liable — unless otherwise provided in paragraph 3 — for the breach of a contractual obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance you as a customer may regularly rely (so-called cardinal obligation), limited to compensation for foreseeable and typical damage. In all other cases, our liability is excluded, subject to the provision in paragraph 3.

(3) Our liability for damages arising from injury to life, body or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

§9 Customer service

§10 Final provisions

(1) Contracts between us and the customer are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and on the applicability of mandatory provisions, in particular of the state in which the customer as a consumer has their habitual residence, remain unaffected.

(2) Should individual provisions of these General Terms and Conditions be invalid, void or incomplete, the validity of the remaining provisions shall remain unaffected. The parties shall — where applicable in the due form — replace the invalid or void provision with a provision, or fill the contractual gap with a provision, by which the economic purpose pursued can best be achieved. If the invalidity or nullity of a provision is based on a measure of performance or time (period or deadline), a legally permissible measure shall take the place of the invalid or void measure of performance or time.

In cooperation with Klarna AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options. Payment is made to Klarna in each case:

  • Invoice: When buying on account with Klarna, you always receive the goods first and you always have a payment period of 14 days. You can find the invoice conditions here.
  • Installment purchase: With Klarna's financing service, you can pay for your purchase flexibly in monthly installments of at least 1/24 of the total amount (but at least EUR 6.95) or under the conditions otherwise stated in the checkout.
